Für Österreich sind die Auswirkungen aber nicht wesentlich, da auch bisher schon das Privatleben von “absoluten Personen der Zeitgeschichte” durch das UrheberrechtsG (§78) geschützt war.

“Diese Bestimmung ist ein Persönlichkeitsrecht, das systemwidrig im UrhG geregelt ist; es regelt den Schutz des Abgebildeten vor
ungewollter Veröffentlichung des eigenen Bildes (nicht der Abbildung an sich). Dabei genügt es, dass die Person des Abgebildeten erkennbar
ist. Die Veröffentlichung von Bildern mit Personen ohne Zustimmung der Abgebildeten ist aber nicht gänzlich untersagt, sondern hängt
davon ab, ob dadurch “berechtigte Interessen” des Abgebildeten (oder im Todesfall) naher Angehöriger verletzt werden. Dabei kommt es auch
auf den Zusammenhang der Veröffentlichung an (Text). Die Veröffentlichung ist etwa dann zulässig, wenn die Abbildung nicht in
einem negativen Konnex erfolgt und auch nicht mit kommerziellen Absichten (Werbung). Dabei kommt es zwar nicht auf das subjektive
Empfinden des Abgebildeten an, die Judikatur ist aber bei dieser Beurteilung ziemlich streng. Es empfiehlt sich daher in
Zweifelsfällen immer die Zustimmung der Abgebildeten einzuholen, bevor man Personenbilder ins Internet stellt, es wäre denn, die
Personen werden nur nebenbei mit abgebildet und nicht in einem negativen Zusammenhang dargestellt.”
